Good deed #479 – Wali permission before marriage

ishah (RA) narrated that Allah’s Messenger (PBUH) said, “Any woman who marries without the permission of her guardian, then her marriage is void (he repeated it three times)”, and he added, “So, if he consummated the marriage with her, she is entitled to the dowry because of what he has attained from her. And if they differ, then the Sultan is the guardian of the one who does not have one.”
(Hadith No. 2083, Book of Marriage, Sunan Abu Dawud, Vol. 2; Hadith No. 1102, Chapters on Marriage, Jami’ At-Tirmidhi, Vol. 2; Hadith No. 1879, Chapters on Marriage, Sunan Ibn Majah, Vol. 3).
Therefore, any marriage without a ‘Wali’ cannot be a valid marriage. However, if a woman has no such relative who can be her ‘Wali’ for marriage, then the ruler of that place can be the ‘Wali’ for that woman.
